Simply Smelling Marijuana No Longer Enough in Massachusetts
The Massachusetts Supreme Judicial Court ruled on Tuesday that police can no longer force people out of their cars, search their shit, and generally harass them just because they smell marijuana during a traffic stop.
The key factor in the decision was the 2008 change in state law which made possession of less than one ounce of marijuana a civil rather than a criminal offense.
Joe Arpaio, known as ‘America’s Toughest Sheriff,’ called the decision “horrible” and “a blow to the burgeoning police state.”
“What if the officers smell marijuana and the people in the car are black or Latino? It doesn’t matter. Police officers will still have to invent other suspicions to proceed with their harassment legally. What the Massachusetts Supreme Court doesn’t realize is that people who smoke pot, especially brown people, are terrorists.”
David Clark, a lawyer and former executive director of Georgia NORML (National Organization for the Reform of Marijuana Laws), called the Massachusetts decision “way groovy” and said that he was “fucking moving there, dude.”
